THE INTERNATIONAL COURT OF JUSTICE ADVISORY OPINION ON CLIMATE CHANGE: IMPLICATIONS AND POLICY FOR SOUTH AFRICA
Abstract
In July 2025, the International Court of Justice (ICJ) delivered a landmark advisory opinion affirming binding obligations on states under international law to take effective action against human induced climate change. This paper analyzes the ICJ ruling’s legal foundations and implications for South Africa, a climate-vulnerable developing country with socio-economic challenges and coal dependence. The ICJ opinion grounds state duties in treaties, customary international law, and international human rights law, mandating "deep, rapid and sustained" emission reductions, prevention of transboundary harm, and equal legal status for adaptation alongside mitigation (International Court of Justice. The paper provides concrete recommendations for reforming South African climate legislation, enhancing ambition, advancing climate justice advocacy, and securing a just transition.
